Landlords Beware: Federal Government Issues New Guidance Regarding The Use of Applicants’ Criminal History Information

A few years ago the federal government “cracked down” on the use of criminal history information by employers.  Now the federal government is making a similar push in the landlord-tenant arena.  The U.S. Department of Housing and Urban Development recently issued “guidance” making clear that landlords and property management companies should not simply exclude anyone with a criminal arrest or conviction in their past.  Rather, they should engage in a sophisticated, multi-factor analysis to determine whether the criminal history actually relates to the application.  

Because most observers expect an uptick in criminal-history-based lawsuits against landlords and property management companies in the next few years, landlords and property management companies are well advised to think through their screening practices.  The presentation will explain what the new “guidance” says, analyze the likely impact of the “guidance”, and offer best practice tips for avoiding lawsuits in the wake of the “guidance.”

  • Directing operations while on-the-scene of major cases and natural disasters, including the NYS Thruway bridge collapse and tactical operations against illegal gambling operations in upstate New York.
  • Masters Degree in Public Administration, Bachelors Degree in Business Administration and Associates Degree in Criminal Justice.
  • Former Editor in Chief of The Gray Rider, the official publication of the Association of Former New York State Troopers.
  • Florida Supreme court Civil Circuit Mediator
  • US Navy Vietnam-era veteran.
